These Terms of Service ("Terms") govern your use of the Traverse application ("the Service," "Traverse"), published under the trading name Adfinium by George Hales, a sole trader based in the United Kingdom ("Adfinium," "we," "us," "our"). By using Traverse you agree to these Terms.
These Terms incorporate by reference the Privacy Policy (A1) and the Health Data Disclaimer (A3), both available on our website and in the app. Both form part of your agreement with us. If you do not agree, do not use Traverse.
1. Definitions
- Adfinium / we / us / our — George Hales, a sole trader in the United Kingdom, trading as Adfinium. Adfinium is a trading name, not a limited company; the business is operated by George Hales personally as a sole trader, with personal liability accordingly.
- Traverse / the Service — the Traverse iOS application and related services.
- You / the user — any individual who installs, accesses or uses Traverse.
- Health Data — any health-related metric, value or annotation you read in from HealthKit, enter manually, or associate with your profile.
- Condition Profile — the conditions, medications and demographic context you declare to calibrate interpretation.
- Report — any narrative, chart, summary or display Traverse produces describing your Health Data relative to published reference ranges and your personal baseline.
- Subscription — the paid Intelligence tier (monthly, annual, or Founders Lifetime).
- Apple — Apple Inc., operator of the App Store and iOS.
2. What Traverse is, and its intended purpose
Traverse is a general wellness and personal-information tool. It reads health metrics from your Apple Watch and other HealthKit-compatible devices, accepts values you enter manually, applies condition-specific reference thresholds derived from peer-reviewed literature, and produces plain-language descriptions of what your data shows relative to your personal baseline and declared profile.
Traverse operates through a three-layer model: (1) published research sets condition-specific thresholds; (2) deterministic mathematics computes your position against those thresholds — identical inputs always produce identical output; (3) plain language narrates the computed result, constrained by an internal framework that prohibits diagnostic, prescriptive or evaluative language.
Intended purpose and limits. Traverse is intended only to help you read and describe your own health information. It is not intended to diagnose, monitor, predict, prognose, prevent, screen for, or treat any disease or medical condition, and is not intended to be relied upon for any medical decision. In particular, Traverse: - does not provide medical advice, diagnosis or treatment recommendations; - does not evaluate whether your health is good, bad, improving or declining; - does not recommend, prescribe or assess medications, dosages or interventions; - does not replace the judgement of a qualified healthcare professional; - is not an emergency-response or alarm system.
You must read and acknowledge the Health Data Disclaimer (A3) before using Traverse. It is presented during onboarding and is available at any time from the website and Settings → Legal.
Note on regulatory status. Traverse is designed and intended to fall outside the definition of a medical device, by virtue of the intended purpose and limits stated above. Regulatory classification depends on intended purpose; we do not present Traverse as a medical device and you must not use it as one.
3. Eligibility
To use Traverse you must: be at least 18; hold an active Apple ID and an iPhone running iOS 18.0 or later; have Apple HealthKit available; and have legal capacity to enter into these Terms where you reside. If you do not meet these criteria you must not use Traverse.
4. Your account
Traverse uses Sign in with Apple. We receive a stable, app-specific identifier, not your Apple ID email (unless you choose to share it). You agree to keep your Apple ID secure, not to share your account, and to notify us promptly of suspected unauthorised access. We are not liable for losses from unauthorised access where the cause is outside our control.
5. Your data and content
- You own your Health Data. We claim no ownership of your metrics, declared conditions, medications or annotations.
- We own the Service — the application, the condition library, the language standard, the prompt architecture and every other component. Your subscription grants a limited licence to use the Service; it transfers no ownership.
- You own your Reports. We grant you a perpetual, irrevocable licence to use Reports generated from your Health Data for any personal purpose.
- Export and deletion are available any time at Settings → Data → Export and Settings → Account → Delete Account. Your data is handled per the Privacy Policy (A1).
6. Subscription, payment, cancellation and refunds
6.1 Free tier. Substantial functionality is free: baseline computation, charts, manual entry, HealthKit sync, condition declaration, and the Disclaimer.
6.2 Intelligence subscription. Unlocks natural-language daily reports and threshold-calibrated narratives. Available as Monthly, Annual, or Founders Lifetime (a one-time purchase granting access for the operational lifetime of the Service; limited seats).
6.3 Pricing. Set in your local currency through the App Store; shown in-app and in the App Store before purchase.
6.4 Free trial. New subscribers may be offered a 7-day free trial, converting to a recurring subscription at the end unless cancelled beforehand through the App Store. Cancel before the trial ends and no charge is incurred.
6.5 Renewal and cancellation. Monthly and annual subscriptions renew automatically unless cancelled through the App Store at least 24 hours before the renewal date. Cancellation takes effect at the end of the current period. Manage subscriptions at Settings → Apple ID → Subscriptions.
6.6 Your statutory cancellation ("cooling-off") right. Where you are a consumer in the UK or EU, you have a statutory right to cancel a distance contract within 14 days. Because Intelligence is digital content supplied immediately, by starting your subscription or trial you consent to immediate supply and acknowledge that your 14-day cancellation right is lost once supply begins, except as the law otherwise provides. For the Founders Lifetime one-time purchase, the same 14-day right applies from purchase, subject to the same immediate-supply rules. App Store purchases are also covered by Apple's refund process at reportaproblem.apple.com. Nothing here removes rights you have under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or equivalent law.
6.7 Refunds. App Store purchase refunds are handled by Apple under Apple's policy; we do not process them directly. Non-waivable consumer-protection rights apply regardless of these Terms.
6.8 Founders Programme. "Lifetime" means the operational lifetime of Traverse. If we discontinue the Service, Founders participants receive no less than 90 days' notice and data export. If we discontinue within [12 months] of a Founders purchase, we will offer a pro-rata or goodwill refund as a matter of fairness. The entitlement is non-transferable.
6.9 Taxes. App Store prices may or may not include VAT/GST depending on region and Apple's tax handling. We are not responsible for taxes beyond what Apple collects and remits on our behalf.
7. Acceptable use
You agree to: provide accurate declarations (interpretation depends on them); not rely on Traverse for medical decisions; not use Traverse in emergencies (contact your local emergency services); not reverse-engineer, decompile, circumvent paywalls, submit fraudulent data, use the Service unlawfully, resell outputs, or use bots/scrapers; and comply with applicable law. We may suspend or terminate for breach, with notice except in severe or repeated cases.
8. Intellectual property
We own Traverse, including the source, binary and assets; the condition library; the language standard (prohibited-phrase dictionary, validation patterns, prompt architecture); the "Traverse" name and brand; and the user-facing copy and design. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Traverse on devices you own or control, for personal, non-commercial use. We claim no ownership of your Health Data or Reports. If you send us feedback, you grant us a perpetual, irrevocable, royalty-free licence to use it without compensation or attribution.
9. Limitation of liability
To the fullest extent permitted by law: - Traverse is provided "as is" and "as available." We make no warranties beyond those that cannot be excluded under consumer law. - We accept no liability for medical decisions made on the basis of Traverse outputs, for the accuracy of user-declared conditions or medications, or for the consequences of inaccurate or incomplete Health Data you input. - We accept no liability for indirect, consequential, special, exemplary or punitive damages. - Our total aggregate liability for any claim arising from your use of the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event, or (b) £100.
Nothing in these Terms excludes or limits: liability for death or personal injury caused by our negligence; liability for fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded (including your statutory rights under the Consumer Rights Act 2015). If you are a consumer in the UK, EU, Australia or another jurisdiction with mandatory consumer-protection law, those protections apply regardless of these Terms.
10. Termination
By you: delete the app, delete your account, or cancel through the App Store at any time. By us: we may suspend or terminate for material breach (with notice where reasonably possible), where your account presents a security/legal/operational risk, or if we discontinue the Service (no less than 90 days' notice + data export). On termination: your licence ends; on-device data remains until you delete the app; server-side data is deleted within 30 days except where law requires retention (e.g. tax records). Sections that by nature survive (IP, liability, disputes, governing law) survive.
11. The Health Data Disclaimer
Your use of Traverse is subject to the Health Data Disclaimer (A3), which you acknowledge during onboarding and which is available on our website and at Settings → Legal. In summary: Traverse does not provide medical advice, does not diagnose, does not recommend treatment, does not evaluate whether readings are good or bad; consult a qualified professional for medical advice; and Traverse is not for emergencies. The Disclaimer forms part of these Terms.
12. Changes to these Terms
For material changes we will notify you in-app and by email if provided and give you a reasonable opportunity to review before they take effect; material changes will not apply retroactively to disputes that arose earlier. For non-material changes we update the "Last updated" date. Continued use after a change constitutes acceptance; if you disagree, cancel and delete your account.
13. Governing law and disputes
13.1 Governing law. These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere, the mandatory consumer-protection law of your jurisdiction continues to apply alongside these Terms. 13.2 Disputes. First contact support@adfinium.co.uk; we acknowledge within 24 hours and try to resolve informally within 30 days. If unresolved, the dispute may go to the English courts (non-exclusive jurisdiction). EU consumers may also use the European Commission's Online Dispute Resolution platform. 13.3 Individual basis. To the fullest extent permitted by law, disputes are resolved individually, not as a class or representative action. This does not apply where prohibited by mandatory consumer-protection law (and does not affect UK consumers' access to the courts).
14. Apple-specific terms
Because Traverse is distributed through the App Store: (a) these Terms are between you and us, not Apple, and Apple is not responsible for Traverse; (b) your licence is limited to use on Apple-branded products you own or control, per the Apple Media Services Terms; (c) we, not Apple, are solely responsible for maintenance and support; (d) we are solely responsible for warranty obligations — if Traverse fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation to the maximum extent permitted by law; (e) we, not Apple, are responsible for product-liability, legal-conformance and consumer claims relating to Traverse; (f) we, not Apple, are responsible for any third-party IP infringement claim relating to Traverse; (g) you represent that you are not in an embargoed/"terrorist-supporting" country and not on a US prohibited-parties list; (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Severability and entire agreement
If any provision is found unenforceable, it is struck and the rest continues. These Terms, with the Privacy Policy and the Health Data Disclaimer, are the entire agreement on your use of Traverse and supersede prior agreements. Our failure to enforce a provision is not a waiver.
